     We, together with our consultants, have been working on a mechanism for integrating the UN’s decision into the TRL structure, as well as into regional legal systems and conventions. Significant work has been undertaken to produce a document containing a complex algorithm, estimates, and a large amount of challenging legal text.

 

     And now we need your help. Completing the TRL Implementation table for every country is going to take a large amount of time, but we have a small team. Therefore, we are appealing to human rights advocates and members of civil society in more than 150 countries with the request to fill out the TRL Implementation table for their country. You can find out what TRL Implementation is and why it is needed here: trl-global.org/implementation

     To make the process as simple as possible, we have already prepared the required formulas, allowing you to find the as many of the documents that have been ratified by your country as possible (these are crucial for the completion of the table). We have also created a Google spreadsheet for online completion as well as an Excel spreadsheet, which can be downloaded from the official TRL Global Foundation website (you are not required to calculate anything as automatic calculation formulas have been set up in the table)

  • We would never have calculated the basic income for every country without our “volunteer movement ‘Implementation’”, as this required filling in more than 12 000 values, all of which were contained in 35 UN depositories and tens of international treaties at the universal and regional level, for more than 200 countries.

Global aim: to maintain up-to-date information for more than 200 countries relating to the following areas

  • The membership of international and regional organizations

  • The fulfilment and/or violation of international treaties at a universal and regional level

  • The national application of ‘Soft Law’ instruments

  • The implementation of recommendations and rulings given by international and regional judicial and quasi-judicial bodies, including the committees of UN Treaty Bodies, as well as statements and recommendations made by UN Special Rapporteurs

  • The exact figures for the basic income of every country as per the Token of Peace algorithms

 

General Plan/Instructions

     The order in which the instructions are described corresponds to the order in which the sections and sub-sections are laid out in the TRL Implementation table. The cells that need to be filled in or in which the figure needs to be changed are indicated in grey.

The basic income of your country can be found here, in the TRL TOTAL column (indicated in yellow): https://trl-global.org/rate (the second table of countries is organised alphabetically)

     Once you have determined the TRL TOTAL of your country, you can begin to fill out the TRL Implementation table [Google docs or Excel spreadsheet]

     The "Convention_depositary" makes reference to ordered links for the regional conventions and UN depositories

 

 

 

1) Choose your region (Europe, Americas, Africa, Asian-Pacific area)

 

2) Write the name of your country in the Country column (cell A4)

3) Insert the figure for the TRL TOTAL (cell B4)

IMPORTANT: you are not required to calculate anything as automatic calculation formulas have been set up in the table

4) Section: INCREASE IN TRL TOTAL. Sub-section: organisation membership.

     If your country is not a member of the United Nations, change the figure in cell C9 to 0; if your country is a member of the United Nations, you do not need to change the figure.

     If your country is not a member of the Council of Europe, the Organization of American States or the African Union, change the figure in column C10 to 0; if your country is a member of the CE, OAS, AU, you do not need to change this figure.

5) Sub-section: international agreements on a universal level

     The ratification of the Universal Declaration of Human Rights (row 13) is not required and is therefore assigned to all countries by default. This increases the basic income simply due to its existence. You do not need to change this figure.

 

     Update column C (rows 14-36) using information about the ratified agreements/conventions in your country. If your country is not on the list of countries that have ratified the given convention, insert the figure 0 in the TRL TI column (column C)

 

 

 

     If you cannot find evidence of ratification, insert the figure 0 in column C.

If your country has ratified the given convention (i.e. it appears on the list of ratified countries), you do not need to change the figure.

Important legal clarification: the document itself should be ratified (documents which have been approved by those ratifying the convention are not considered).

     Rows 32 and 34 should be left blank for now.

6) Sub-section: international agreements on a regional level

See section “Regional Specificities” (can be found at the bottom of the instructions: point 10)

7) National Soft Law Instruments

     If there is evidence of the implementation of the United Nations Declaration on Human Rights Education and Training in national educational programmes and strategies in your country, you do not need to change the figure in cell C52; if there is no information regarding its use, change the figure in cell C52 to 0.

     If your country does not provide a standing invitation for UN special procedures, change the figure in C53 to 0.

     If your country has not signed the UN Framework Convention on Climate Change, change the figure in C54 to 0.

8) Section: DECREASE IN TRL TOTAL. Sub-section: TRL implementation UN

     If any statement in rows 59 - 72 is not correct (i.e. is untrue/the violations indicated have not been committed) for your country, change the current figure in the corresponding C cell to 0. If the statement is correct, do not change the figure.

9) Section: UN Universal Human Rights Index

10) “Regional Specificities”

Europe

Rows 39 and 40 concern the unique work carried out by the Council of Europe and the ECHR.

  • In cell B39 write the number of Council of Europe conventions that have been ratified by your country.

  • If your country has not ratified the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, change the figure in cell C40 to 0

TRL implementation: Council of Europe (European Court of Human Rights)

     TRL implementation: The Council of Europe has a very complex yet very accurate scoring system, which we hope will eventually be used in other conventions for a more accurate reflection of a state’s fulfilment of implemented obligations.

     In cells C80 - C94 write the figure (number of cases/violations) corresponding to the descriptions in the rows.

The Americas

If your country has not ratified the Pact of San José, change the figure in cell C39 to 0.

If your country does not recognise the competencies of the Inter-American court of Human Rights, change the figure in C40 to 0.

If your country has not ratified any document (rows 41-47), change the figure in the corresponding cells to 0 (column C; indicated in grey)

TRL implementation: Organisation of American States (the inter-American system for the protection of human rights)

If any statement in rows 80 - 94 is not correct (i.e. is untrue/the violations indicated have not been committed) for your country, change the current figure in the corresponding C cell to 0. If the statement is correct, do not change the figure.

Africa

If your country has not ratified any document (rows 39-41), change the figure to in the corresponding cells to 0 (column C; indicated in grey)

Send the completed sections/rows/cell to the Local Coordinator for your country for the subsequent creation of a pool of tables
